This guide covers the body of laws governing the status, treatment, and disposition of human remains in the United States. Disputes over human remains--both before and after final disposition--arise quite frequently, and the emotional and psychological stakes of the outcome are high. This area of law is essentially defined by state common and statutory law; there is little federal law. There has been little uniform law activity in this area, so although common law doctrines are fairly consistent from state to state, statutory laws vary widely.
