Shortfalls of the 1996 Immigration Reform Legislation

2010, Hein's Electronic Documents Reprint Series, Immigration, Law Reform admin

Hein’s Electronic Document Reprint Series, #26

In 1996 there were three major laws passed that related to immigration:
  • The Illegal Immigration Reform and Immigration Responsibility Act of 1996
  • The Personal Responsibility and Work Opportunity Reconciliation Act of 1996
  • The Antiterrorism and Effective Death Penalty Act of 1996
Each of these laws has provisions that have been contested by various groups over time. The first was controversial because it doubled the U.S. Border Patrol and allowed for illegal immigrants to be deported upon the commission of a minor offense, among other reasons. The second greatly restricted any funding to immigrants, both legal and illegal. The third is criticized for a limitation that forecloses the power of the federal courts to remedy unjust convictions set forth by state courts.
